1. What we do
We set up and run AI-powered "helpers" for local businesses. Depending on your plan, that can include: - Replies: drafting replies to your Google and BBB reviews - Answers: missed-call text-back and an AI phone receptionist - Review Booster: review-request texts and a counter QR code - Chuckwagon: AI phone and text order taking for restaurants (currently a pilot program) - Other jobs listed on our Pricing page or agreed with you in writing
We tailor each helper to your business (its name, tone, greeting, hours and rules), based on what you tell us.
2. AI disclosure
Our helpers use artificial intelligence. - Calls: callers are told they are speaking with an AI assistant. - Review replies: nothing posts without your approval. You review and approve replies before they go live, unless you tell us in writing to post approved types of replies automatically. - AI can make mistakes. We check its work, but you're responsible for reviewing what goes out under your business name, and for telling us right away if something's wrong.
3. Your account and information
You agree to give us accurate information about your business, and to keep your contact details current. You're responsible for any logins, Google Business Profile access, or other access you give us, and you confirm you have the right to give it.
4. Prices, billing and refunds
- Month to month. Plans are billed monthly, in advance, on the card or account you provide. Prices are shown on our Pricing page or in your written quote.
- Cancel anytime. You can cancel by emailing [email protected]. Cancellation takes effect at the end of your current billing month, and you won't be billed again.
- No refunds for months already billed. We don't offer a money-back guarantee, and we don't refund or prorate a month once it's billed.
- Setup fees are non-refundable, because they cover work we do up front.
- Price changes. We'll give you at least 30 days' notice by email before changing your monthly price, except where a locked rate applies (see Section 5).
- Late payment. If a payment fails and isn't fixed within 10 days of our notice, we may pause your services until it is.
- Taxes. Prices don't include any taxes that apply. You're responsible for them.
- No guaranteed results. We don't guarantee any number of calls, bookings, orders, reviews, ratings or sales. Results depend on your customers and your business.
5. Founder rate
- The founder rate (Trail Boss at $299/mo, setup waived) is available to our first 5 founder clients, while spots last.
- It's locked for 12 months from your first billed month, as long as your account stays active and paid. After 12 months your plan continues at our then-current Trail Boss price, and we'll email you at least 30 days before that change.
- If you cancel or your account is paused for non-payment, the founder rate ends and can't be reclaimed.
- We may ask founder clients for a short testimonial. It's optional and never a condition of the rate, and we'll only publish a testimonial with your written OK.
6. Referral program
- Launch phase: each business you refer that becomes a paying client (after paying its first full month) earns you 1 free month of your current plan.
- Later phase: after our first 25 paying clients or 90 days after launch, whichever comes first, referrals switch to a $40/mo credit for each referred business that remains a paying client. We'll post the switch date on our site.
- Earned stays earned. Free months and credits earned before the switch are honored.
- No cap, with carry-over. Credit beyond your monthly bill carries over to your next bill.
- Credit only, never cash. Referral credit has no cash value and can't be transferred, sold or paid out. Unused credit ends if you cancel.
- If a referred client cancels, any monthly credit tied to them stops on their next billing date. Credit already applied or banked isn't taken back.
- Referrals must be separate, real businesses. Your own other locations or businesses don't count, and they get the multi-location discount instead. We may refuse or reverse credit earned through fraud or abuse.
7. Multi-location discount
For businesses with the same owner, the 2nd location is 25% off and the 3rd and later locations are 35% off the same plan. Setup is half price on each added location. Discounts apply only while all the locations are active, paying accounts.
8. Your responsibilities for reviews and texting
You're the business, so you're responsible for how your helper is used. You agree to: - Ask every customer, the same way. No review gating: don't ask us to send review requests only to happy customers or to filter people away from your review page. - No incentives for reviews (no discounts, freebies or contest entries), and no fake, employee or paid reviews. - Only give us numbers you have permission to text. You'll only provide phone numbers of customers who gave you their number and agreed to hear from your business, and you'll keep a record of that consent. - Honor opt-outs. Every text we send for you includes "Reply STOP to opt out," and we'll stop texting anyone who opts out. Don't ask us to text them again. - Follow the laws and rules that apply to you, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, the FTC's rule on consumer reviews and testimonials (16 CFR Part 465), Google's review policies, carrier rules (including 10DLC registration), and any privacy rules for your industry (for example, healthcare privacy rules if you're a dental or medical practice). - Give us accurate information for carrier registration of your texting number.
We may pause or refuse any message, reply or campaign we believe breaks these rules.
9. SMS / text messaging terms
These apply to anyone who gets texts from Hill Country Helpers, either about our own services or on behalf of one of our client businesses. - Program: Hill Country Helpers sends texts about your request or account (for example, replies to your inquiry, appointment and order updates, and missed-call follow-ups). For our clients, we also send texts on the business's behalf, such as missed-call replies, order confirmations, appointment reminders and review requests. - Consent: we only text people who gave their number and agreed to receive texts. Consent is not a condition of purchase. - Message frequency varies. - Message and data rates may apply. - Opt out: reply STOP at any time to stop receiving texts. You'll get one confirmation text, and then no more texts from that program. - Help: reply HELP for help, or email [email protected]. - Carriers are not liable for delayed or undelivered messages. - Privacy: we never share or sell mobile numbers or text opt-in consent to third parties or affiliates for marketing. See our Privacy Policy.
10. Restaurant ordering (Chuckwagon pilot)
Chuckwagon is a pilot program. We load your menu and prices from what you give us, and you're responsible for keeping us updated on menu, price, hours and allergen changes. Orders are passed to your kitchen by text or email, and payment happens at pickup unless we agree otherwise. You're responsible for checking orders and for food preparation, safety and allergen information. We're not responsible for missed, incorrect or unpaid orders, though we'll work with you to fix issues quickly.
11. Third-party services
Our services rely on third parties such as phone and texting carriers, Twilio or similar providers, Google, BBB and AI providers. We're not responsible for their outages, policy changes or decisions (for example, Google removing a review or a carrier rejecting a registration).
12. Ownership
You own your business content, customer lists and reviews. We own our templates, systems and know-how. You give us permission to use your content only to provide the services. Pip and the Hill Country Helpers name and logo belong to Estrada Legacy LLC.
13. Acceptable use
Don't use our services for anything illegal, deceptive, harassing or spammy, and don't use them to impersonate anyone. We may suspend or end service for any violation.
14. Ending service
You can cancel anytime (see Section 4). We may end or suspend service with notice if you break these Terms, don't pay, or if continuing would put us out of compliance with the law or carrier rules. When service ends, we'll stop sending messages for you and, on request, return or delete your data as described in our Privacy Policy.
15. Disclaimers
Our services are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the services will be uninterrupted or error-free.
16. Limitation of liability
To the fullest extent the law allows: - We aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, customers or data. - Our total liability for any claim relating to the services is limited to the amount you paid us in the 3 months before the claim arose.
17. Indemnity
You agree to cover our costs (including reasonable attorneys' fees) if a claim is brought against us because of your content, the numbers or instructions you gave us, or your breach of these Terms or the law, including texting and review laws.
18. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in Travis County, Texas. Before filing anything, both sides agree to try to resolve the issue informally by email for 30 days.
19. Changes to these Terms
We may update these Terms. We'll post the new version here with a new effective date, and email active clients about material changes at least 30 days before they take effect.
